Establishing a Trust
In Florida, a trust is a legal document that allows an individual to set aside assets and appoint a representative ("trustee") to manage their assets on behalf of the designated beneficiaries. Establishing a trust can be an effective way to avoid probate upon death, which can save families time, money, and additional stress while grieving the loss of their loved one. There are different types of trusts that Floridians can choose from when planning their estate, including:
- Living Trusts – Also known as “revocable trusts,” living trusts permit the grantor to transfer assets into a trust during their lifetime. This means that the trust will go into effect as soon as it’s signed and officialized by the court.
- Testamentary Trusts – Commonly referred to as “irrevocable trusts,” testamentary trusts are created through the grantor’s Last Will and Testament. Unlike revocable trusts, testamentary trusts will only go into effect after the grantor’s death.
It’s worth noting that living trusts must be funded to be amended by the grantor. If the trust is unfunded upon the grantor’s death, it may be subject to probate, which can defeat one of the primary advantages of establishing a trust.
